Kathryn McCarthy is Counsel in the Firm’s Litigation Department.  She specializes in counseling clients on how to best preserve, collect, process, review and produce electronic data and other forms of discoverable material in merger investigations, civil litigation matters, grand jury proceedings and other government inquiries.  She also has extensive experience in substantive antitrust analysis and therefore offers a unique value to clients who face burdensome discovery obligations both in the merger review context and antitrust litigation.

Ms. McCarthy’s responsibilities include maximizing efficiencies in the handling of substantial discovery projects.  She routinely negotiates and implements electronic discovery protocols with both governmental agencies and private parties.  She suggests and evaluates appropriate consultants and vendors for specific projects and negotiates to obtain agreements with these parties on terms favorable to clients.  Ms. McCarthy supervises all aspects of data retrieval by coordinating with client information systems employees and external consultants.  During document review, she manages and monitors productivity and accuracy of attorney teams operating under extremely tight deadlines.

Ms. McCarthy earned a BA in Economics from Villanova University and a law degree, cum laude, from Albany Law School where she was an editor of its Law Review. She is admitted to practice in the state and federal courts of New York.  She speaks regularly on various topics related to antitrust and electronic discovery.
